Advance notification
Employers are typically required to notify the competent authorities in the destination country before sending their employees on business travel to Europe. Failure to file the required advance notification can result in severe penalties for employers, with fines reaching up to EUR 500,000.
We can assist clients in determining whether a declaration or notification is required in their specific circumstances and, if necessary, support them in preparing and filing the required documentation.

Identification of posting requirements
When posting employees to work in another country in Europe, employers must ensure that their employees receive the labour conditions required by the destination country.
These conditions may include remuneration, overtime rates, work hours and rest periods, paid annual leave, health and safety measures, and reimbursement for travel, board, and lodging costs. Labour conditions vary across Europe, streaming from numerous legal sources and changing dynamically.
With the support of posting experts in many European countries, we are well-equipped to guide businesses in arranging lawful postings of their employees.

PD A1, Assignment Letter & Other Documents
Before the start of the posting the employers must ensure that their posted employees are provided with a Portable Document A1 and an Assignment Letter. These documents will be required during inspections in the destination country.
A properly drafted Assignment letter is essential for minimizing potential penalties and reputational risk for non-compliance as well as for preventing adverse tax implications.
Many destinations countries also require employers to maintain time sheets, pay-slips and other posting related documents for inspections. In some countries they should be translated into local languages, drafted, and formatted according to specific requirements, etc.

Most European countries require employers to retain documents for inspection not only during but also for a certain period after the posting of their employees.
Each country has its own rules regarding the retention and storage of posting documents. Some countries require employers to appoint a local representative, such as a certified accountant or lawyer, to maintain these documents on-site and present them to local authorities upon request.
